As you will be aware a corporation can buy property in England and Wales. Sometimes, the register needs to be updated and where a conveyancer or solicitor has not been appointed (they can identify their client and submit the documents to HMLR on their clients behalf) HMLR will want to ensure that the correct corporation is submitting the change.
When I am asked to complete these forms, I check not only the identity of the signer on the day using their passport or driving licence, but also that of the company. I need to check that they are duly registered in the place that they are incorporated, still trading, still able to trade, not subject to any sanctions, and that the person signing the document has the legal capacity and authorisation to bind the company in such a way.
As with other HMLR identification forms, it is normal for either the conveyancer or solicitor collating the document, or HMLR themselves to contact me, to ensure that I have completed that form. The time it takes for that to happen depends on who is asking and at what stage of the process the check is taking place. Further to this, the service provided is identification only. I am not a conveyancer nor a notary that practices conveyancing so I cannot provide you with any legal advice on the underlying transaction.
The form requires me to identify you too, so do make sure that you have everything you need at the appointment.
If you have one of these, or the other ID forms from HMLR, please don’t hesitate to contact me for a quote.
